These Terms & Conditions ("Terms") govern your use of the QzariDigitals platform, including the Creator Empire Studio software and all related websites, tools, and services (collectively, the "Service"). The Service is operated by Wamaiya Benefield, a sole proprietor doing business as "QzariDigitals" ("we", "us", "our"). You can reach us at support@qzaridigitals.tech.

By creating an account or by continuing to use the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization. If you are using the Service as an individual, you confirm you are of legal age in your jurisdiction.

The Service provides AI-assisted content creation and digital marketing tools for creators and small business owners, including (without limitation) listing copy, captions, pin generation, content planning, brand voice tools, and related features. Feature availability depends on the plan you select.

You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information at sign-up and to keep it up to date. Notify us promptly of any unauthorized use of your account.

You must not misuse the Service. In particular, you agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose;
• Send spam or unsolicited communications;
• Infringe anyone's intellectual property, privacy, or other rights;
• Probe, scan, or test the Service for vulnerabilities, introduce malware, scrape, or otherwise interfere with the Service's security or normal operation;
• Reverse engineer, decompile, or attempt to extract the source code;
• Resell, sublicense, or redistribute the Service or its outputs as a competing tool;
• Circumvent any usage limits, rate limits, or technical restrictions.

The Service uses generative AI models to produce text, images, and related outputs ("Outputs"). You are responsible for:

• The prompts and inputs you submit;
• Reviewing Outputs for accuracy before you publish or rely on them;
• Ensuring you have the rights to any content you submit as input;
• How you use, publish, or distribute the Outputs.

Accuracy disclosure. Outputs may be inaccurate, incomplete, or inappropriate for your specific use case. The Service is not a substitute for professional advice (legal, financial, medical, tax, or otherwise). You must independently verify Outputs before relying on them, especially for any regulated or professional context.

Prohibited uses of AI features. You must not use the Service to generate or distribute illegal content, child sexual abuse material, non-consensual intimate imagery, deepfakes intended to defraud or harass, hate speech, malware, or content that jailbreaks, prompt-injects, or otherwise attempts to bypass the safety controls of the underlying models.

Rights & takedowns. As between you and us, you retain rights to your inputs, and you own the Outputs you generate to the extent permitted by applicable law and the underlying model providers' terms. If you believe Output infringes your rights, contact us at support@qzaridigitals.tech and we will review and act on valid takedown requests. We may suspend or terminate accounts that are the subject of repeated or serious infringement claims.

We reserve the right to filter, refuse, or remove Outputs and to suspend accounts that misuse AI features.

You retain ownership of the content you submit to the Service ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you.

The Service, including its software, design, branding, documentation, and underlying technology, is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your chosen plan.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period at the then-current rate, until cancelled. You can cancel anytime from your billing portal (managed by Paddle); cancellation takes effect at the end of the current paid period.

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or always meet your expectations. We may modify, suspend, or discontinue features from time to time.

To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service or these Terms is limited to the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.

Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

You agree to indemnify and hold us harmless from any claim, loss, or expense arising from (i) Your Content, (ii) your use of the Service in breach of these Terms, or (iii) your violation of any law or third-party right.

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends and we may delete your account data after a reasonable period.

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by notice in the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the United States and the state in which the seller resides, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, except where applicable consumer law grants you the right to bring proceedings elsewhere.
